§ 1 Provider and scope
These General Terms and Conditions (Terms) apply to all contracts for the use of Widget Fox between

(hereinafter the “Provider”) and the customer.
Widget Fox is aimed exclusively at entrepreneurs within the meaning of § 14 BGB. No contract is concluded with consumers within the meaning of § 13 BGB. The customer confirms when booking that they act as an entrepreneur.
Deviating or additional terms of the customer apply only if the Provider expressly agrees to them.
§ 2 Conclusion of contract
The contract for the Free plan is concluded when the customer signs up with their email address and confirms the login link.
The customer books the Pro plan from their account. Before going to the payment page, the customer confirms that they act as an entrepreneur and states their company name. The contract for Pro is concluded when the customer completes the payment process.
These Terms can be viewed on this page at any time and can be saved and printed.
§ 3 Payment processing through Stripe and Link
Payment for Pro runs through Stripe Managed Payments. Sold through Link, LLC (Link), a company of the Stripe group, processes the payment. Link calculates and reports the sales tax and issues receipts and invoices to the customer. The terms of Link also apply to the payment process.
The Provider alone is the customer’s contractual partner for the services of Widget Fox.
§ 4 Services
Widget Fox enables the customer to create widgets that show, for example, reviews of a Google profile or posts of an Instagram account, and to add them to their own website with an embed code. The widgets are delivered as finished files through a CDN in the EU.
There are two plans:
- Free: 1 widget, up to 200 views per month, branding link in the widget, sync weekly.
- Pro: up to 5 widgets, unlimited views within the fair-use limit, no branding link, sync daily.
A view is one loading of a widget in a visitor’s browser. If the customer on the Free plan reaches the limit of their plan in the current month, a widget with Google reviews shows only a preview mode with overall rating, stars and branding link, without individual reviews, until the end of the month; other widgets show a neutral notice instead of the content until the end of the month.
On the Pro plan, a fair-use limit of 1 million views per customer and month applies, counted across all of the customer’s widgets. If the customer exceeds it, the Provider gets in touch with the customer to clarify the use. The widgets are not switched off automatically in this case.
The content in the widget consists of copies as of the time of the last sync, not a live display. The Provider retrieves it from publicly accessible pages of third-party providers such as Google and Instagram. These third-party providers can make the retrieval technically difficult or prevent it. In that case an update may temporarily not be possible; the widget then shows the last successfully synced state. The Provider does not warrant that the use of the content is compatible with the terms of these third-party providers, and reserves the right to discontinue a data source if operating it is no longer possible or reasonable.
The Provider may further develop and change the services where this is necessary for good cause, for example because of security, a change in the legal situation, technical development or the loss of a data source, and the agreed core services of the plan remain in place.
§ 5 Availability
The Provider endeavours to keep the dashboard, the sync and the delivery of the widgets available without interruption as far as possible. No particular availability is agreed. Excluded are in particular announced maintenance and disruptions at third-party providers outside the Provider’s sphere of influence.
§ 6 Prices and payment
Free is free of charge. Pro costs €9 per month or €72 per year. Prices include tax. A trial period for Pro is not provided; the Free plan is there for trying things out.
The fee is due in advance at the start of each term and is collected through the payment method chosen in the payment process.
If a payment fails, Pro stays active for a grace period of 7 days. If the payment is not made up by then, the account automatically switches to the Free plan; its limits and features then apply. Widgets and settings are not deleted in the process.
§ 7 Term and termination
The Free plan runs for an indefinite period. The customer can end it at any time by deleting their account in the dashboard. The Provider can terminate the Free plan with a notice period of four weeks.
Pro runs for one month or one year, depending on the customer’s choice, and renews automatically for the same term each time unless it is cancelled. The customer can cancel Pro at any time in the dashboard or by email, effective at the end of the paid term. Until then Pro stays active; afterwards the account continues on the Free plan.
The right of both sides to extraordinary termination for good cause remains unaffected. Good cause for the Provider exists in particular if the customer, despite a warning, connects profiles or accounts that are not theirs or uses Widget Fox unlawfully.
§ 8 Price changes
The Provider does not change prices for running contracts unilaterally. A price change for a running contract applies only if the customer expressly agrees to it. If the customer does not agree, the contract continues at the previous price; the Provider’s right to ordinary termination at the end of the term remains unaffected.
§ 9 Voluntary money-back commitment
The Provider voluntarily refunds the first payment for Pro if the customer requests this by email to info@widget-fox.com within 30 days of this payment. The refund is made through the original payment method. With the refund, Pro ends and the account continues on the Free plan. There is no statutory right of withdrawal because Widget Fox sells only to entrepreneurs. Under its own terms, Link may grant refunds independently of this.
§ 10 Obligations of the customer
The customer assures and undertakes
- to connect only Google profiles and Instagram accounts that belong to their own business or that they are authorised to use,
- to add the embedding of the widget to their own privacy policy, in particular the delivery through the Provider’s CDN at Bunny.net,
- to inform on their website whether and how they ensure that the reviews shown come from customers who actually used the service (§ 5b para. 3 UWG); the Provider supplies a standard text for this on request,
- not to select reviews in a misleading way; if the customer uses the filter by stars, the notice “Selection from X Google reviews” stays visible in the widget,
- not to use Widget Fox unlawfully and to protect access to their email inbox, through which the login runs, from access by third parties.
For members of healthcare professions and other customers to whom special advertising rules apply, the following also applies: they check for themselves whether showing reviews, and in particular using the filter by stars, is compatible with these rules, for example with the German Act on Advertising in the Healthcare Sector (HWG).
If the customer culpably breaches these obligations, the customer indemnifies the Provider against third-party claims based on this, including the reasonable costs of legal defence.
§ 11 Rights in content
The customer grants the Provider the rights in the content that the customer enters into Widget Fox that are necessary to create and deliver the widgets. The Provider acquires no further rights.
§ 12 Data protection and data processing
How the Provider processes the customer’s personal data for its own purposes is set out in the Privacy Policy.
Where the Provider processes personal data on behalf of the customer, in particular the data of reviewers and the data of visitors when the widgets are delivered, the Data Processing Agreement applies. It is part of this contract and is concluded electronically together with it.
§ 13 Liability
The Provider is liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of an assumed guarantee.
In cases of simple negligence, the Provider is liable only for the breach of an essential contractual obligation, that is, an obligation whose fulfilment is what makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. In this case liability is limited to the typical, foreseeable damage.
Strict liability for defects that already existed when the contract was concluded (§ 536a para. 1 alt. 1 BGB) is excluded.
These rules also apply to the liability of the Provider’s vicarious agents.
§ 14 Changes to these Terms
Changes to these Terms for running contracts apply only if the customer expressly agrees to them. If the customer does not agree, the previous Terms continue to apply; the Provider’s right to ordinary termination remains unaffected.
§ 15 Final provisions
The law of the Federal Republic of Germany applies.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Hannover.
Should a provision of these Terms be invalid, the contract remains valid in all other respects.
